Permit Reports & Reporting

Note: All reports, notifications, or other submissions must be submitted to the Permitting Branch Supervisor and Solid Waste Permit Writer. Digital submittals are prefered by the NDEP-BSMM.

Solid Waste Tracking and Disposal Reports
All applicable solid waste management facilities must report Solid Waste Tracking and Disposal Reports (SWTDR) in accordance with NRS 444.560. The report shall be submitted by a method prescribed by the Division:
- Entering the information directly into the Division managed SMART Database; or if the SMART Database form is not available
- An NDEP-BSMM assigned form
Each applicable solid waste management facilities is assigned a reporting frequency inside each respective permit. No matter the reporting frequency, a SWTDR is due 30 days after each calendar period ends. See the table below for each reporting frequencies and their respective due date to submit to the Division.

Groundwater Monitoring Reports
Certain applicable solid waste management facilities are required to conduct groundwater monitoring in accordance with NAC 444.7481 to NAC 444.7499 inclusive. Groundwater monitoring is conducted to monitor potential contaimiation to groundwater from the site and to monitor any potential off site migration.Each applicable solid waste management facilities is assigned a reporting frequency inside each respective permit. See the table below for each reporting frequencies and their respective due date to submit to the Division.

Financial Assurance Reports
Per NRS 444, as amended by AB40 during the 2025 legislative session, applicable solid waste management systems must include a Closure Plan and a detailed third party cost estimate to provide evidence of Financial Assurance pursuant to NAC 444.685 to NAC 444.6859 inclusive. The estimate must reflect the cost of closing the facility at its maximum planned inventory. Solid waste management facilities are assigned a unique reporting frequency inside each respective permit. See the table below for each reporting frequencies and their respective due date to submit to the Division.

Landfill Capacity Reports
All solid waste landfills (excluding Class III Waiver Landfills) are required to conduct a topographic survey or other volumetric survery approved by the solid waste management authority at least once every 5 years until the site is closed. Each report must be submitted not later than 5 years after the date on which the immediately preceding report was submitted. Solid waste management facilities are assigned a unique reporting date inside each respective permit.

Landfill Gas Monitoring Reports
All solid waste landfills (excluding Class III Waiver Landfills) are required to conduct perimter landfill gas emmision monitoring in accordance with NAC 444.667 and NAC 444.735(3). Each applicable solid waste management facilities is assigned a reporting frequency inside each respective permit and are required to keep the records onsite and available for review. Only specific facilities are required to submit the results to the NDEP-BSMM for review, see the table below for each reporting frequencies and their respective due date to submit to the Division if applicable.

Note: EPA’s New Source Performance Standards (NSPS) for Municipal Solid Waste (MSW) landfills (40 CFR Part 60, Subpart XXX) require landfills constructed, modified, or modified after July 17, 2014, to install gas collection and control systems (GCCS) if they have a reach a design capacity of at least 2.5 million Mg and 2.5 million cm³ and produce NMOC emissions ≥ 34 Mg/year.

Spill Reports (Fire + Incident Reporting)
All applicable solid waste management facilities shall report any noncompliance, imminent or existing hazard from a release of waste or hazardous constituents, any fire or explosion at the facility, or any condition which may endanger human health or the environment.
Such information shall be reported to the Division within 24 hours from the time the Permittee becomes aware of the circumstances by any of the following methods:
- By telephone to the Emergency Response Commission (Spill Hotline) telephone at (888) 331-6337; or
- Online at: Spill Report Form
A written report MUST be submitted to the NDEP-BSMM within 15 days of the incident report submission and must include the following:
- Name and title of person making report;
- Date, time, and type of incident;
- Name(s) and quantity of material(s) involved;
- A complete description of the occurrence and its cause;
- The extent of injuries, if any;
- An assessment of actual or potential hazards to the environment and human health outside the facility, where this is applicable;
- Estimated quantity and disposition of recovered material that resulted from the incident;
- Actions taken by the Permittee in response to the incident; and
- Actions taken by the Permittee to prevent similar incident from occurring.
