EPA Approves Nevada Drinking Water Primacy Revision Request - Stage 1 DBPR

U.S. Environmental Protection Agency Region 9 (EPA) has determined that Nevada’s program revision request for the federal Stage 1 Disinfectants and Disinfection Byproducts Rule (DBPR), set forth in 40 CFR Part 141 Subparts G, L and U, is complete and final pursuant to 40 C.F.R. § 142.12(d)(3).

EPA has also determined that Nevada’s regulations that effectuate the requirements of the federal Stage 1 DBPR in the Nevada Administrative Code (NAC) 445A.4525 are comparable to and no less stringent than the federal requirements at 40 CFR Part 141 Subparts G, L and U. The Nevada Attorney General has certified that these provisions have been duly adopted and are enforceable.

EPA intends to publish its determination to approve Nevada’s program revision request for the federal Stage 1 DBPR in the Federal Register and will provide the public with an opportunity to request a public hearing. If no substantive requests are received within thirty (30) days after publication in the Federal Register, and EPA has determined that a hearing is not necessary, the determination will become final and effective immediately.
