Notice of Public Workshop Bureau of Safe Drinking Water
The Nevada Division of Environmental Protection (NDEP), Bureau of Safe Drinking Water (BSDW), is proposing to “adopt by reference” federal regulation amendments in the following sections of Nevada Administrative Code (NAC): NAC 445A.450 Definitions, NAC 445A.4525, Adoption by reference of certain provisions of federal regulations, NAC 445A.454 Primary standards: Monitoring and analysis, NAC 445A.4845 Consumer confidence reports, and NAC 445A.485 Notification requirements.
The proposed regulation changes will provide Nevada with the ability to maintain primacy of the Safe Drinking Water Act regulations by adopting the PFAS Rule, Lead and Copper Rule Revisions/Improvements (LCRR/LCRI) and the Consumer Confidence Report Rule (CCR). Primacy grants NDEP the authority to implement and enforce federal regulations in Nevada. The following Codes of Federal Regulations (CFR) are proposed to be adopted by reference into Nevada Administrative Code: 40 CFR § 141.900 to 141.905 (PFAS Rule), 40 CFR § 141.80 to 141.93 (LCRR/LCRI Rules), and 40 CFR § 141.151 to 141.156 (CCR Rule).
