EPA Approves Revision to Nevada’s State Primacy Program Effectuating the Federal Radionuclides Rule
The U.S. Environmental Protection Agency Region 9 (EPA) has determined that Nevada’s program revision request for the federal Radionuclides Rule, set forth in 40 C.F.R §§ 141.25, 141.26, and 141.66, is complete and final pursuant to 40 C.F.R. § 142.12(d)(3).
EPA has also determined that Nevada’s regulations that effectuate the requirements of the federal Radionuclides Rule into Nevada’s Administrative Code (NAC) at 445A.4525 are comparable to and no less stringent than the federal requirements at 40 C.F.R. §§ 141.25, 141.26, and 141.66. The Nevada Attorney General has certified that these provisions have been duly adopted and are enforceable.
EPA intends to publish its determination to approve Nevada’s program revision request for the federal Radionuclides Rule in the Federal Register and will provide the public with an opportunity to request a public hearing. If no substantive requests are received within thirty (30) days after publication in the Federal Register, and EPA has determined that a hearing is not necessary, the determination will become final and effective immediately.
