Air Forum Bylaws - 09/01

1. Name

    1.1 This organization shall be known as the Clark County Air Quality Forum or CCAQF or Air Forum and shall address air quality issues of interest to the State of Nevada, Clark County jurisdictions and the general public.

    1.2 The address of the CCAQF shall be that of the Nevada Division of Environmental Protection, 333 West Nye Lane, Carson City, Nevada 89706-0851.
2. It shall be the goal of the CCAQF to:
    * Identify issues regarding the air quality of Clark County.

    * Use the Air Forum to build consensus and share public information regarding air quality.

    * Coordinate study efforts, provide technical updates and disseminate information to the public.

    * Serve as a clearinghouse on air quality issues and provide peer review.

    * Enhance the public input process through a collaborative forum.

    * Formulate and secure funding for further research that may be necessary.
3. Members
    3.1 Members of the Air Forum shall consist of federal, state and local governmental entities as well as organizations and local citizens who have an interest in the air quality.

    3.2 The Division of Environmental Protection shall maintain a current mailing list of all Air Forum members, alternates and other interested individuals including the public and special interest groups. Those on the mailing list shall be sent notice and a written agenda for Air Forum meetings at least ten (10) days prior to the meeting.

    3.3 All members shall serve without compensation from the Air Forum. All expenses incidental to a member's involvement shall be borne by that member, or, if appropriate, his/her respective agency.

    3.4 Signatories to the MOU recognize that the statutory or regulatory responsibilities of participating entities cannot be delegated. The Air Forum shall not supplant any regulatory authority related to air quality.

    3.5 An alternate or proxy identified in writing by an Air Forum member may sit in place of that member and assume all of the privileges and responsibilities of that member.
4. Meetings
    4.1 Meetings shall be held at least every ninety (90) days or more frequently as deemed necessary by the Air Forum chairperson.

    4.2 Resolutions, recommendations or other actions by the Air Forum must be agreed upon by consensus. Consensus is reached when it becomes evident through deliberation that every member, at the very least, does not oppose an action or decision. In its deliberations, the Air Forum shall use appropriate tools for developing consensus, and shall seek to exhaust every reasonable and practicable effort to reach consensus.

    4.3 Air Forum meetings shall be chaired by a representative of the Nevada Division of Environmental Protection or designee. Meetings shall be held in the Las Vegas Area at a location selected by the chairman of the Air Forum.

    4.4. Air Forum members agree to participate in meaningful and civil discussions on issues and actions brought before the Air Forum. The chairperson may remove from the meeting, any member of the Air Forum or the public who does not conduct himself/herself professionally or in the spirit of constructive dialog.

    4.5 The Nevada Division of Environmental Protection has the responsibility for arranging for future meeting dates, time, and location. The Division shall be responsible for notifying members of the meetings and for arranging for meeting facilitation and administrative support.
5. Document Repository
    5.1 An official document repository consisting of the Memorandum of Understanding, Bylaws, meeting minutes, correspondence, investigations, data and other pertinent information shall be maintained at the offices of the Nevada Division of Environmental Protection at the Las Vegas office located at 555 East Washington Avenue, Suite 4300, Las Vegas, Nevada 89101 and at the Carson City office located at 333 West Nye Lane, Carson City, Nevada 89706-0851. Documents residing within these repositories shall be available to the public during normal business hours in accordance with Nevada Public records laws.
6. Public input
    6.1 A major function of the Air Forum is to solicit and receive input, written and oral, from the public. Each meeting must include an opportunity for general public input and discussion. The general public must also be allowed to provide input to specific issues and actions discussed or enacted by the Air Forum.
7. Termination
    7.1 An Air Forum member may terminate their participation in the CCAQF by informing the remaining members of the Air Forum in writing. Termination shall be effective 5 days from the date of the notice.
8. Amendments
    8.1 These bylaws may be amended, supplemented or repealed by consensus of the Air Forum.
9. Additional Members
    9.1 The Air Forum may appoint additional members if and when the need arises as agreed by consensus.
