Notice: The 2007 Construction Stormwater General Permit (NVR100000) has been administratively continued while a permit renewal is being drafted. Renewal notices will be mailed once the new permit has been issued.
User Instructions: NDEP requires owner/operators to obtain a Construction Stormwater Permit if the project will disturb more than one (1) acres, or will disturb less than one (1) acre but is part of a larger common plan for development or sale that will ultimately disturb one (1) or more acres. If the construction site will disturb less than five (5) acres and meets certain criteria, the site may be eligible for a construction stormwater permit waiver.
If NDEP determines that a project less than one (1) acre in size will impact receiving waters or its tributaries within a 1/4-mile radius of the project, the owner/operator of the project will also be required to obtain a construction stormwater permit.
If the construction site requires a construction stormwater permit, the owner/operator must complete a
Notice of Intent (NOI)
for coverage under the Construction Stormwater General Permit NVR100000. After filling in the required information, you will need to print out the confirmation page, have an authorized person sign it, then send the confirmation page and a $200 filing fee to NDEP at the address listed below.
