Bureau of Waste Management - Chemical Action Program

09/29/2000

Amendments are being proposed to the Chemical Accident Prevention Program regulation (NAC 459.952 - 459.95528). The proposed changes are the result of directives from the 1999 Nevada State Legislature through the following bills:

    AB-173 Amends CAPP List of Highly Hazardous Substances
    AB-535 Subjects Explosives Manufacturing to CAPP
    AB-536 Requires Permits to Construct from NDEP
A January, 2001 hearing date before the State Environmental Commission is anticipated. Workshops are scheduled in October, 2000 and written comments will be accepted through November 10, 2000.

The Nevada Division of Environmental Protection is holding workshops to solicit comments on proposed revisions to Nevada solid waste recycling regulations. Two regulations are proposed. The first will establish minimum standards to provide collection of source-separated recyclable materials at public buildings. The second will establish procedures for paper recycling at state agencies. Workshops have been scheduled in Las Vegas and Carson City.

Public notice of intent to issue a disposal site permit and notice of public hearing. On August 10, 1999 the Administrator received a complete application for a permit to construct and operate a Class I disposal site from Crestline Recycling and Disposal, Inc. The applicant is seeking authorization to operate a Class I disposal site. The Administrator has scheduled a public hearing pursuant to NAC 444.6415(2)(a) for 7:00 pm, November 8, 2000 at the Caliente Youth Center, Multi Purpose Room in Caliente, Nevada.

Public Notice of Intent to Modify a Class II Landfill Permit. The Administrator has received a request to modify a Class II landfill permit from the City of West Wendover, Nevada. The applicant is seeking authorization to waive methane monitoring requirements for five (5) years.

Notice of Workshops to Solicit Comments on Proposed Regulation Amendments.  The Nevada Division of Environmental Protection (NDEP), Bureau of Air Quality is proposing the amendment of regulations pertaining to chapter 445B of Nevada Administrative Code. Three workshops have been scheduled around the state.

The Administrator has received a complete application for a water pollution control groundwater discharge permit (#NEV2000507) from NEWMONT MINING CORPORATION, 427 RIDGE STREET, SUITE C, RENO, NV 89501.

The applicant proposes to discharge up to 18,000 gallons per minute (gpm), 25.9 million gallons per day (MGD), of mine dewatering water to groundwater of the State via a series of five rapid infiltration basins in Township 34 N, Range 42 E, Sections 16 and 17. The discharged water will meet the standards of Nevada Administrative Code (NAC) 445A.144. No treatment is proposed for the first phase of this project. The alluvial aquifer in an adjacent section meets drinking water standards. The discharge rate is planned to be increased to 45,000 gpm, 64.8 MGD, to eliminate the applicant's dewatering discharge to the Humboldt River from this site. The permit is written to ensure that the discharge does not degrade the groundwater and will cover a five year period.

The United States Department of Energy, Nevada Operations Office (DOE/NV) has submitted to the Nevada Division of Environmental Protection (NDEP) a Closure Plan (Closure Plan for Corrective Action Unit 110: U-3AX/bl Disposal Unit, Nevada Test Site, Nevada) in August 2000.

The Closure Plan was submitted pursuant to the requirements of their Resource Conservation and Recovery Act (RCRA) Permit #HW009, Subpart G & K of Part 265 of the Code of Federal Regulations (40 CFR 265) and Nevada Administrative Code (NAC) 445A.227, for the closure of the U-3ax/bl Disposal Unit in Area 3 of the Nevada Test Site (NTS).

The Nevada Division of Environmental Protection (NDEP) is requesting public comment upon the DRAFT PERMIT for a non-radioactive hazardous waste storage unit and a nonradioactive explosive ordnance disposal unit owned by the United States Department of Energy. The facilities are located on the Nevada Test Site approximately 65 miles northwest of Las Vegas, Nevada.

The Administrator has received an application for an Underground Injection Control (UIC) permit which has been drafted for public comment. Permit #UNEV2000210, has been applied for by the following applicant: Payless/Allstate Car Rental, 5175 Rent-A-Car Road, Las Vegas, Nevada 89119

The applicant has submitted a remediation plan in response to a release of petroleum hydrocarbon contamination from Payless/Allstate Car Rental located at 5175 Rent-A-Car Road, Las Vegas, Nevada. The applicant proposes to remediate the released hydrocarbon contamination utilizing subsurface injection of a dilute hydrogen peroxide solution. The hydrogen peroxide injectate should facilitate the biodegradation of the hydrocarbon contamination. Monitoring will be required to ensure that groundwater is not degraded.

Action #1) The Administrator has received a complete renewal application (#NV0021849) for a water pollution control discharge permit from the following applicant: WELLS MANUFACTURING COMPANY, 2 ERIK CIRCLE, VERDI, NV 89439. The applicant operates a manufacturing facility which produces stainless steel commercial cooking equipment. The applicant proposes to continue discharge of non-contact cooling water to the Truckee River via a Sierra Pacific Power Company by-pass ditch in Verdi, Nevada. The permit will be renewed for a five (5) year period.

Action #2) The Division is also soliciting comment on the adoption of a proposed Truckee River TMDL Exemption policy. This policy would set a threshold for evaluating the daily load of total nitrogen and total phosphorous from small discharges which are considered to be "de minimis". This approach will provide a means for exempting small discharges from the requirement to obtain an Individual Wasteload Allocation (WLA) under the TMDL process. Assigning de minimis WLAs and revising the TMDLs for every small NPDES permittee would be a large workload burden on Division staff with minimal or no environmental benefit.

The Administrator has received a complete application for a modification of a water pollution control discharge permit from the following applicant: Dayton Utilities Company/Lyon County, Rolling "A" Water Reclamation Facility, P. O. Box 1699, Dayton, Nevada 89403 The applicant requests a modification of the existing discharge permit for the Rolling A wasterwater treatment facility to include an interim primary lined aerated wastewater treatment pond at the plant site for use until the activated sludge mechanical wastewater treatment plant is constructed and operational. The interim use will terminate September 30, 2001. The proposed interim treatment pond will use disposal via evaporation.

The Administrator has received a complete application for modification and renewal of a water pollution control discharge permit from the following applicant: Indian Hills General Improvement District (IHGID), 924-D Mica Drive, Carson City, NV 89705

The permittee proposes to operate an extended aeration package wastewater treatment plant (WWTP) at 1001 Hobo Hot Springs Road in Indian Hills, Douglas County, Nevada. The new plant replaces the IHGID wastewater utility's pond treatment system which serves the Indian Hills General Improvement District and the adjacent service area. The modification request is to upgrade the system to a new facility and to increase plant flow and treatment capability to a maximum design peak flow of 1.5 million gallons per day (MGD). The WWTP provides advanced secondary treated effluent which is disposed to groundwaters of the State via onsite irrigation and off site golf course reuse under a separate permit.

The Administrator is proposing various amendments to the Nevada Underground Injection Control (UIC) Regulations, NAC 445A.810 to NAC 445A.925, inclusive. The UIC program is designed to protect underground sources of drinking water from degradation by regulating the fluids injected through a well. The proposed amendments to the UIC regulations are necessary to ensure that Nevada retains primacy for the UIC program by meeting the federal UIC regulations, which were recently amended. Additionally, amendments are also necessary to reflect current program requirements and needs.

The Administrator has received complete documentation for a water pollution control discharge renewal permit (#NEV40031) from the Internal Revenue Service, c/o EG&G Technical Services, US Customs Service Support, 3702 Pender Drive, Suite 400, Fairfax, Virginia 22030.

The applicant is currently in responsible control of the former Mustang Ranch operated by the A.G.E. Corporation at 155 East Mustang Ranch Road in Mustang, Nevada. The applicant proposes to continue to treat wastewater in a septic tank and dispose of the treated effluent to the groundwaters of the State via leach fields. The system serves the former Mustang Ranch facilities and the current Old Bridge Ranch facility.

Bureau of Water Quality Planning

The Bureau of Water Quality Planning has scheduled two public workshops.  The workshops will focus on proposed revisions to the Nevada state water quality standards for the Walker River (Nevada Administrative Code 445A.159 through 445A.169) and new water quality standards for Walker Lake pursuant to Section 303 of the Clean Water Act.
