User Instructions: We suggest users read the fact sheet and the general permit listed below and related information to determine if your activity requires a construction stormwater permit.

If you are subject to the permitting requirements, please complete a Notice of Intent (NOI) for coverage under the General Permit by completing the Online form (see link below.) After completing the online form you will need to print the document and mail it to NDEP at the address indicated.

Applies to:

Construction activity defined under Category X of 40 CFR §122.26(b)(14). Stormwater Discharge Associated with Construction Activity, applying to projects disturbing at least one acre.
