Concentrated Animal Feeding Operations Permits are required for certain activities by U.S. EPA regulations at 40 CFR Part 412. In compliance with these regulations, the Nevada Division of Environmental Protection (NDEP) requires that concentrated animal feeding operations (CAFO) seek coverage under the appropriate permit type.

November 20th, 2011 - CAFO Program Update - New CAFO Reporting Rule — The EPA developed a proposed rule that would require owners or operators of CAFOs to submit basic information to the EPA within one of the following options:

First option - all CAFOs would be required to report information to the EPA, unless states with authorized NPDES programs choose to provide the information on behalf of CAFOs within the state

Second option - only CAFOs in focus watersheds that have water quality concerns associated with CAFOs would be required to report information to the EPA - Nevada does not have any of these focus watersheds.

The EPA is proposing to collect the following specific information from ALL CAFOs:

  • Contact information,
  • Location of the CAFO's production area,
  • Whether the operation has NPDES permit coverage,
  • Number and type of animals held in confinement and
  • Number of acres available for land application of manure

Both options would apply to unpermitted and permitted CAFOs

EPA is requesting public comment on both proposed rule options and the alternative approaches for gathering information identified in the proposal. The deadline to submit comments is December 20th, 2011.
